B9 11772. Kort geding over vervroegde Reve-biografie. Joop Schafthuizen probeert vandaag met een kort geding alsnog het omstreden derde deel van de Gerard Reve-biografie tegen te houden. Dat heeft zijn advocaat bevestigd. Vrijdag verscheen de biografie van Nop Maas, De late jaren (1975-2006), drie weken eerder dan aangekondigd was. Lees hier meer (NRC).

Een kunstzinnig kopiërende hoogleraar. Al schilderend overtuigt hoogleraar Peter van Bergeijk vakgenoten van het nut van plagiëren. (…) Met dit kunstzinnige kopieerwerk wil Van Bergeijk vooral zijn wetenschappelijke vakbroeders een boodschap brengen: Ga meer namaken en andermans werk overdoen! Dat is vloeken in de kerk, want in de wetenschappelijke wereld geldt autoplagiaat als een milde vorm van fraude. Stichting Thuiskopie weerlegt uitslag PwC-onderzoek. Het klopt niet dat de schade van privékopiëren voor rechthebbenden op 12 miljoen euro uitkomt. Dit meldt Stichting Thuiskopie naar aanleiding van een PwC-rapport. De conclusie van het onderzoek van PwC naar de schade van privékopiëren is dat de prijsverhoging die op 1 januari wordt doorgevoerd op spelcomputers, mobiele telefoons, tablets, digitale televisies of andere apparatuur om gederfde inkomsten van thuiskopiëren te compenseren, veel te hoog is. De Nationale Vereniging van Dagbladen (ANJ) riep haar leden op de dienst te boycotten omdat de zoekmachinegigant weigert de kranten te betalen voor het gebruik van hun headlines. Russian Prime Minister Dmitry Medvedev feels that international copyright agreements need renovation. He said as much when addressing the Antikontrafakt-2012 forum on ways to fight pirate goods in the city of Krasnogorsk, in Moscow Region, earlier today. Medvedev said that Russia would soon adopt a new Civil Code wording to more effectively ensure the balance of interests of the copyright holder, author and user, and also to prevent the spreading of pirate goods. Aboriginal copyrights to be reviewed next year. Applications by Aboriginal tribes to have the ownership of original Aboriginal naming rights, intellectual property and other items returned to the tribes, in accordance with the Indigenous Peoples Intellectual Property Act, are to be reviewed by March next year. Sesame Street sends 'Sexy Big Bird' seller a cease and desist letter. The people over at Sesame Street have had just about enough of a particular unauthorized "Sexy Big Bird" costume. Legal Alert De Brauw: Online database infringement takes place in targeted Member State. (…) The ruling implies that digital infringers of databases cannot avoid infringement by locating their server in a jurisdiction where it is difficult for them to be sued (e.g. outside of the EU) or by making it very hard to locate their server at all. It is interesting that the CJ ruled that the infringing act takes place "at least' in the Member State of the country at which the infringing act is directed. The referring court had asked specifically to clarify whether the infringing act (also) takes place in the country where the server is located but this issue was not addressed[iii] (whereas the Advocate General recommended that the CJ conclude that the infringing act takes place there as well). The Pirate Bay moves to the cloud to avoid police raids. This week, file sharing website The Pirate Bay moved its services to cloud-based hosting providers across the world. This change of infrastructure protects The Pirate Bay against police raids, as there are no physical servers to confiscate anymore. This measure also makes it harder to take the website offline. In addition, The Pirate Bay states that this solution is cheaper and reduces downtime for users. The cloud-based hosting providers have no idea that they are hosting The Pirate Bay. Bedrijf achter Ice-Watch-horloges beschuldigt verkoper kermisgadgets van namaak. De BVBA Duppie Toys, een bedrijf uit Zemst dat kermissspeelgoed en -gadgets verkoopt, heeft zich voor de Brusselse correctionele rechtbank moeten verantwoorden voor namaak. Het bedrijf was gedagvaard door TKS, de firma achter de populaire Ice-Watch horloges omdat het zou geprobeerde hebben 1.000 nagemaakt Ice-Watch-uurwerken in te voeren vanuit China. The EU declares war on blind pirates. A rumour is circulating that at the next negotiating round on the Treaty of the Visually Impaired at the World Intellectual Property Organization the members of the European Blind Union will attend the meeting with black pirate flags and one pirate patch over each eye. According to the European Union´s representatives in Geneva this week, the Treaty for the Visually Impaired is not principally about guaranteeing the right to read of millions of blind persons who presently only have access to around 1% of the books published. On the contrary, for the EU this is not a question of basic human rights but, instead, a question of dangerous piracy by blind persons whose subversive quasi criminal activities could mean the beginning of the end of global Intellectual property protection! Decision: Transfer. On the basis of the record, the Panel could not establish that Complainant’s Trademarks are well known. However this may be, the Panel notes that the Trademarks, which are effective and enforceable in the Netherlands, predate the registration of the Domain Name by Respondent. On the balance of probabilities, the Panel finds it more likely than not that, as Complainant claims, Respondent was aware of Complainant’s Trademarks at the time of registration. Even in the absence of any such positive awareness, in the circumstances of this case it would have been incumbent on Respondent to examine the rights position in relation to the Domain Name.
