B9 11720. Hotdogverkoper Hans Worst boos over 'HEMA-plagiaat’. Hotdogverkoper Hans Worst, al 10 jaar een bekende verschijning op de Rotterdamse Coolsingel, is witheet op de HEMA. Dit weekend gaat HEMA de musical in première waarvoor een als worst verklede acteur (Hans Worst) reclame maakt. 'Plagiaat', zegt Rotterdamse Hans Worst (echte naam: Hans Bode) in het AD. 'Ik verkoop als Hans Worst al tien jaar hotdogs en heb in het jaar dat ik begon ook mijn merknaam geregistreerd. Dan kan een ander die zich niet zomaar toeëigenen.' Lees hier meer (AD).

Ali B pleegt plagiaat met programma. Ali B maakt met Ali B Op Volle Toeren kans op een Televizierring, maar volgens twee dames die zeggen te werken bij de TROS is het programma helemaal niet zo bijzonder. De vrouwen zochten contact met RTL Boulevard om te vertellen dat zanger Mick Harren twee jaar geleden een dergelijk idee heeft voorgelegd. "Het programma zou Mick in Mokum heten", zo laat de zanger zelf weten. "Ik ben daar geweest met een format en ik heb het allemaal afgewacht. Het is wel een beetje wrang, maar je moet niet bij de pakken neer gaan zitten", relativeert Mick. Lees hier meer (DeStentor).

Twee jaar cel voor downloaden in Japan. Japan gaat het downloaden van auteursrechtelijk beschermd materiaal bestraffen met maximaal twee jaar cel en boetes die kunnen oplopen tot omgerekend 20.000 euro. Het downloaden van muziek en films met auteursrechten is al sinds 2010 illegaal in Japan, maar werd tot nu toe niet bestraft. Onder druk van de muziekindustrie is daar nu verandering ingekomen. F-side wil naam terug. De F-Side wil dat een bedrijf dat supportersartikelen voor Ajax maakt, afstand doet van de naam F-Side. Dat heeft Ronald Pieloor, lid van de bestuursraad van Ajax, bevestigd. Het bedrijf waarvan Ronald Pieloor de naam buiten de publiciteit wil houden liet de naam F-Side in 2002 deponeren.Sindsdien komen supporters de naam soms tegen op kleding en andere merchandising die onder andere worden verkocht in kraampjes bij de Arena. Spotify expected to report major losses. A great challenge for Spotify will be how they can continue to afford offering their customers music content for free or at the current low rates. The company's financial sheets show that they are spending most of their money on payments of music royalties and licensing fees. Of course that is no surprise: as they do not produce their own content, Spotify has to buy. However, basically they have been selling products below their purchase price and, in general, that is not a sustainable business case. Lees hier meer (FOC).

The Patent, Used as a Sword. “There’s a real chaos,” said Richard A. Posner, a federal appellate judge who has helped shape patent law, in an interview. “The standards for granting patents are too loose.” (…) Cleaning up the patent mess, Judge Posner said in an interview, might also require reducing the duration of patents on digital technologies, which can be as long as 20 years. “That would make a big difference,” he said. “After five years, these patents are mainly traps for the unwary.” Lees hier meer (NY Times).

Google Deal gives publishers a choice: Digitize or Not. After seven years of litigation, Google and book publishers said on Thursday that they had reached a settlement to allow publishers to choose whether Google digitizes their books and journals. Lees hier meer (NY Times).

Tweedehands mp3-verkoper voor de rechter. In New York is vrijdag een rechtszaak begonnen tussen muziekproducent EMI en ReDigi, een site die mensen hun mp3's laat doorverkopen aan anderen. Volgens ReDigi is haar businessmodel net zo legaal als verkoop van tweedehands CD's, maar EMI vindt dat de 'first-sale-regel', die het legaal maakt om fysieke voorwerpen te herverkopen, niet van toepassing is op digitale goederen. Eyeworks fights Banijay format claim. In a statement, Banijay International said that Eyeworks’ Sterren Springen (aka Celebrity Splash) “may borrow format elements too heavily” from Banijay’s primetime gameshow TV Total Turmspringen (aka High Diving). Both formats involve celebrities diving into swimming pools. Banijay has hired copyright infringement experts to assess the legal situation and is considering taking action against Eyeworks. Obama-Biden on IP. Do IP lawyers and other aficionados of the abstract estate vote for presidential candidates based on their IP policies? That would be sick. But if you want to factor that into your choice, I’ve blogged somewhat about the present President’s IP enforcement policies (hint:  which candidate does Hollywood support?) Jolanda van de Kamer benoemd tot Chief Operating Officer Buma/Stemra. Per 1 november 2012 is mevrouw Jolanda G.M. van de Kamer benoemd tot Chief Operating Officer van Buma/Stemra. Van de Kamer gaat vanuit deze directiefunctie leiding geven aan de Buma/Stemra backoffice met een focus op de optimalisatie van de uitgevoerde processen en de distributie van de gelden. Badr Hari boos op Comedy Central. Het leek Comedy Central wel een leuk idee om een advertentie te gebruiken waarop te zien is hoe Charlie Sheen in gesprek is met zijn psycholoog om te leren omgaan met zijn woedeaanvallen. De psycholoog draagt de outfit van een bokser en op de capuchon staat de naam Badr Hari. De advocaat van Badr laat aan Shownieuws weten: "Dit is onrechtmatig gebruik van de naam Badr Hari en voorts wordt inbreuk gemaakt op zijn merkrechten. Inloggegevens DigiD gaan naar verkeerde DigiD. Nederlandse gemeenten leven de voorschriften van Logius over DigiD niet goed na. Gemeenten verwijzen vaak naar Digi-D. Een reclamebureau met die naam heeft al meer dan 10.000 gegevens ontvangen.Het Algemeen Dagblad meldt vandaag dat een reclamebureau uit Waalwijk dagelijks per mail DigiD-inloggegevens ontvangt van burgers. Lees hier meer (Webwereld).

UN's copyright agency won't let the Pirate Party in. International non-governmental organizations with an interest in copyright and related issues have always been admitted to the United Nations's World Intellectual Property Organization (WIPO) as observers (…) But starting in the middle of the last decade, public interest groups like Creative Commons and EFF started to attend these meetings, adding balance and an emphasis on human rights to the treaty-making debates. Pirate Party International satisfies every one of the criteria used to evaluate NGOs for WIPO observer status. Small claims for copyright on track. England and Wales have a new ‘small claims track’ at the Patent County Courts, simplifying the process for copyright owners who want to take action against others who they believe have infringed their rights – and whilst this may well involve commercial disputes, a number of commentators have pointed out that the Court could hear civil cases against individual suspected file-sharers. The main limit to the court’s jurisdiction is the usual cap for damages for small claims which cannot exceed £5,000. Lees hier meer (1709).

Microsoft claims ownership of the number 45, asks Google to censor the US government and Bing. A series of monumentally sloppy, automatically generated takedown notices sent by Microsoft to Google accused the US federal government, Wikipedia, the BBC, HuffPo, TechCrunch, and even Microsoft Bing of infringing on Microsoft's copyrights. Microsoft also accused Spotify (a music streaming site) of hosting material that infringed its copyrights. The takedown was aimed at early Windows 8 Beta leaks, and seemed to target its accusations based on the presence of the number 45 in the URLs. Lees hier meer (BoingBoing).

The Nigerian Copyright Commission has seized three containers, loaded with over 3,000 cartons of various pirated bibles, educational and inspirational books. At a press briefing held in Lagos, the zonal manager of the commission, Mr. Chris Nkwocha explained that the containers were falsely declared as containing Christian books but on examination, pirated educational books were found inside. No Doubt en Activision treffen schikking. Rockband No Doubt en gameuitgever Activision hebben een schikking getroffen over het portretrecht van de bandleden in het muziekspel Band Hero. Spelers konden met virtuele representaties van de bandleden muzieknummers naspelen van onder meer The Rolling Stones. Activision heeft de aantijgingen van de band steevast ontkend. Pirate Bay-oprichter krijgt paspoort terug. Fredrik Neij, medeoprichter van The Pirate Bay, heeft van de Zweedse ambassade in de Thaise hoofdstad Bangkok zijn paspoort teruggekregen nadat hij beroep had aangetekend tegen een eerdere intrekking van zijn reisdocument. Lees hier meer (Tweakers).

RIAA richt vizier op Nederlandse linkjessite. De Amerikaanse muziekindustrievereniging RIAA neemt een Nederlandse website met torrents op de korrel. De website jou-site.me deelt links naar auteursrechtelijk beschermde informatie, maar de WHOIS-gegevens liggen in de kluis van Whoisguard.com. Alleen de privacygarantie van deze organisatie gaat ook maar zo ver, want een rechter dwingt het bedrijf de gegevens de onthullen. Lees hier meer (Webwereld).

Politie neemt 240 kilo namaak-Dash en kilo’s bedorven voedsel in beslag. Bij een controle in enkele nachtwinkels heeft de lokale politie van de zone Brussel West 240 kilo namaakwaspoeder in beslag genomen. Chocoladefabriek wint kleurwedstrijd. Heeft het luxe schoenenmerk Louboutin laatst de slag om de kleur rood gewonnen. Het Britse chocolademerk Cadbury mag vanaf nu beslag leggen op de kleur paars. Zij het in combinatie met chocoladerepen en -dranken. Dat besloot een rechter in Londen in de zaak die was aangespannen door concurrent Nestlé. Lees hier meer (Telegraaf).
