EHRM: wederom schending rechten ambtenaar Moldavië door ontslag na lekken naar pers

Publicatie. De zaak betreft een ambtenaar die in 2003 naar de media heeft gelekt dat vanuit de overheid in Moldavië druk werd uitgeoefend op het OM. De ambtenaar werd ontslagen, maar moest weer in dienst worden genomen nadat het EHRM in 2008 oordeelde dat het ontslag een schending van artikel 10 EVRM betekende. Na een korte en oncomfortabele periode (de ambtenaar kreeg geen toegangspasje waardoor hij voor de deur van het gebouw moest wachten op collega’s en had geen kantoor waardoor hij in de bibliotheek moest werken) werd hij opnieuw ontslagen.

 

Het EHRM oordeelt dat ook dit ontslag een schending van artikel 10 EVRM oplevert. Gelet op de bovengenoemde omstandigheden en de omstandigheid dat op de dag van zijn terugkeer op kantoor al voorbereidingen werden getroffen voor zijn ontslag, bestaat volgens het EHRM voldoende reden om aan te nemen dat het ontslag wederom een vergelding is voor het lekken naar de media in 2003. De beperking was bovendien niet noodzakelijk in een democratische samenleving, zo oordeelt het EHRM overeenkomstig haar eerdere beslissing. In dit kader wordt de nationale rechter verweten dat het in zijn geheel niet heeft gekeken naar artikel 10 EVRM:

 

60. Instead of fulfilling their primary role under the Convention protection system by examining factors which were central and essential under the Convention, the domestic courts limited their examination of the case to verifying whether formalities such as the approval by the trade unions had been obtained, and whether section 14(8) of the Public Service Act was applicable to the applicant’s situation. An issue as important as the alleged repeated failure to observe the applicant’s rights as found to have been breached in Guja (cited above) was not among the questions examined by the domestic courts, in spite of the fact that that issue was at the heart of the applicant’s defence.

 

61. In the light of the above, the Court comes to the conclusion that the interference with the applicant’s right to freedom of expression, in particular his right to impart information, was not “necessary in a democratic society”. There has accordingly been a violation of Article 10 of the Convention.
