The first senate at the Federal Supreme Court (Bundesgerichtshof – BGH), responsible for trade mark, design, copyright and unfair competition law, has a new presiding judge and the senate seems to be more willing to address the CJEU with preliminary proceedings. For the first time this report also includes commercial aspects of copyright law. Again, German courts filed lots of requests
for interim decision to the CJEU."
