union-IP bericht: "Literal infringement and the doctrine of equivalence from a European perspective - How should one draft patents that are infringed?
The landmark decision "Occlusion device", rendered by the BGH, started intense discussion amongst practitioners as to how to draft patents that can be successfully enforced. UNION-IP picks up this discussion and has invited judges and representatives from industry and private practice to share their views and opinion with us.
What experiences from patent litigation should be taken into account when drafting a patent application? Is it advisable to include many embodiments in the application as fall back positions to be able to manoeuvre if the patent is challenged? Or is it better to draft patent applications with only few embodiments to avoid problems if a patent infringement is asserted under the doctrine of equivalence? What quality standards should a patent fulfill?

We will hear from experienced judges suggestions for drafting patent applications in view of the recent case law concerning patent infringement. We will discuss with representatives of major companies case studies and quality standards applied to patents in industry. And we will look at an international comparison of claim interpretation to see how a claim wording works in different jurisdictions.
