Inschrijving woordmerk ‘METABOX’ geweigerd wegens verwarringsgevaar met ‘META4’

Merkenrecht. Beroep tegen weigering van inschrijving van het woordmerk METABOX door Sun Media in klasse 35 (reclame), 38 (telecommunicatie), 41 (entertainment) en 42 (hosting). Het bedrijf Meta4 Spain, houder van onder andere het woordmerk META4, heeft oppositie ingesteld tegen deze inschrijving. De oppositie is toegekend, behalve voor bepaalde diensten in klasse 41, namelijk entertainment diensten en in het bijzonder elektronische en online entertainment diensten. Bij de Kamer van Beroep kreeg Sun Media al ongelijk omdat de gelijkenissen tussen de merken zouden zorgen voor verwarringsgevaar, in ieder geval bij Spaans publiek.

 

Het beroep bij het Gerecht faalt. Sun Media voert onder meer aan dat niet alleen gekeken had moeten worden naar het element ‘meta’, maar naar de totaalindruk van de merken. Ook zou er geen sprake zijn van verwarringsgevaar vanwege de begripsmatige verschillen. Het Gerecht merkt op dat de Kamer van Beroep wel heeft gekeken naar de woordmerken in het geheel.

Visueel gezien komt het element ‘meta’ in beide merken voor. Het is waarschijnlijk dat het eerste element van een woordmerk de aandacht van de consument krijgt. De elementen achter ‘meta’ zijn korter en daarom is het minder waarschijnlijk dat dit de aandacht van de consument krijgt. Daarmee is het op visueel gebied gemiddeld overeenstemmend. Op auditief vlak wordt vastgesteld dat beide merken het element ‘meta’ bevatten en daarmee een zekere mate van overeenstemming hebben.

 

“72. (...) it is likely that neither the earlier marks nor the mark applied for will have a clear and specific meaning for a significant part of the relevant Spanish-speaking public. In particular, contrary to what the applicant claims, it is unlikely that a significant part of the relevant public would perceive the earlier marks as referring to the English word ‘metaphor’ or would attribute meaning to the element ‘box’ of the mark applied for. It follows that, irrespective of the way in which the relevant public will perceive the common element ‘meta’ of the signs at issue, the conceptual comparison of those signs will remain neutral for a significant part of the relevant public. Moreover, those signs have at least a low degree of conceptual similarity for that part of the relevant public which will understand the meaning of the element ‘box’ of the mark applied for. Consequently, contrary to what the applicant claims, it must be stated that, for a significant part of the relevant public, those signs do not have any conceptual differences that might offset their visual and phonetic similarities.”

 

Voor de toepassing van de weigeringsgrond uit artikel 8 lid 1 sub b UMeV is het niet vereist dat het verwarringsgevaar moet bestaan in alle lidstaten en alle taalregio’s van de Unie. Dat verwarringsgevaar bestaat bij het Spaans sprekende deel van het relevante publiek, is voldoende om de inschrijving te weigeren.

 

“74. Finally, it should be borne in mind that, according to established case-law, where, as in the present case, one of the earlier marks on which the opposition is founded is an EU trade mark, it is not a requirement of Article 8(1)(b) of Regulation No 207/2009 that, for the mark applied for to be refused registration, the likelihood of confusion must exist in all the Member States and in all the linguistic regions of the European Union. The unitary character of the EU trade mark means that an earlier EU trade mark can be relied on in opposition proceedings against any application for registration of an EU trade mark which would adversely affect the protection of the first mark, even if only in relation to the perception of consumers in part of the EU (see judgment of 18 September 2012, Scandic Distilleries v OHIM — Bürgerbräu, Röhm & Söhne (BÜRGER), T460/11, not published, EU:T:2012:432, paragraph 52 and the case-law cited).”
