De Duitse regering had de wetgeving voor de inwerkingtreding van het UPC al aangenomen, maar het Bundesverfassungsgericht steekt daar nu - kort voor het einde van de wetgevingsprocedure - een stokje voor. De grond hiervoor is, zo berichten diverse Duitse media, een hoger grondwettelijk bezwaar, ingediend door een tot nu toe onbekend gebleven privépersoon.
Het Bundesverfassungsgericht heeft de Bundespresidenten verzocht, de reeds door de regering aangenomen wetgeving niet uit te voeren.
Duitsland behoort naast Frankrijk en het Verenigd Koninkrijk tot de drie staten waarvan de participatie voor de inwerkingtreding van het UPC vereist is.

Op 7 juni jl. heeft het Unified Patent Court zelf al bericht dat de deadline voor het inwerkingtreding van het UPC in december 2017, niet houdbaar is:
"The progress of national procedures concerning the ratification of the UPC Agreement and the participation in the Protocol on Provisional Application is being continuously monitored with a view to publish a new timetable on this website as soon as possible.
An operational team is currently overseeing the final preparations for the recruitment of judges, testing the IT and case management systems and ensuring that resources are trained and in place before the UPC's entry into operation.
A new timeline for the recruitment process of the UPC judges will be communicated as soon as possible to all candidates who have submitted applications."
