Merkenrecht. EU-oppositieprocedure o.g.v. van het internationale woordmerk CADENACOR tegen de inschrijving van de aanvraag voor het gemeenschapswoordmerk COR (meubels). Soortgelijk waren en COR wordt aangemerkt als het dominerende element, CADENA als beschrijvend (winkelketen) en de oppositie wordt toegewezen.
65/66. In the present case, the trade mark COR does not have any meaning in Spanish whereas, as stated in paragraph 47 above, the mark CADENACOR means ‘COR chain’, that is, ‘COR chain of shops’. (…) In view of the visual and phonetic similarities between the signs, and the inappositeness of the conceptual comparison, it must be concluded that the signs COR and CADENACOR are similar.
