EU-Rapport en motie on copyright and generative AI – opportunities and challenges

Rapid advances in AI, particularly generative large language models, challenge the effective enforcement of copyright, privacy and non-discrimination rights, creating legal uncertainty and disadvantaging the EU. Technological innovation must respect existing laws, while regulation must not stifle development. The EU should urgently establish a balanced, long-term framework reconciling AI progress with copyright protection.
This report proposes a General Copyright Protection Regulation, improved licensing mechanisms, transparency obligations, and a machine-readable opt-out system supported by an EUIPO-managed register. It also suggests fair remuneration for the use of protected works in AI training, potentially through flat-rate fees, including retroactive compensation. Safeguarding press publishers, democratic values and cultural diversity is essential. A harmonised European approach is needed to ensure legal clarity, fair competition and sustainable AI innovation.
