In an article published last year, Judge Richard Posner and Professor Albert Yoon surveyed about 200 federal district court judges on various issues, including the judges overall impression of the quality of legal representation, by civil practice area. Amongst these groups, the judges identified intellectual property litigators as the giving the highest impression of quality. In addition, the judges noted their impression that there is not typically any significant disparity in the quality of representation between the intellectual property litigators on any given case. An analysis of their history, rationales and possible future, by Stef van Gompel. The surprise is that, having been schooled in the prevalent sentiment of the past half century that formalities are a historical relic, he has found in this book a well-argued case for their fresh and objective evaluation, if not their immediate relevance. Steunt het Filmfonds RODAP? Producenten en makers hebben al enige tijd een verschil van mening over hoe de vergoeding voor auteursrechten geregeld moet worden. Moet deze vergoeding via de exploitanten i.s.m. producenten (via RODAP) aan makers uitgekeerd worden of is het beter dat PAM, een portal dat opgericht is door makers, de verdeling van auteursrechtelijke vergoedingen op zich neemt? Als het Filmfonds hier het RODAP initiatief ondersteunt dan kiest het Filmfonds zonder dat makers zich ervan bewust zijn de kant van producenten en dat is zorgelijk. Lees hier meer.

German government strongly advocates munich as seat of central divison of EU Unified Patent Court. In one of our latest postings on the legal and political shadows of the Unified Patent Court Agreement we concluded that the stuck ‘seat issue’ will now have to be decided on the top executive level, i.e. in personal talks between Federal Chancellor Angela Merkel, Prime Minister David Cameron, and - should he survive the French presidential election in April/May 2012 - Nicolas Sarkozy as the only serious and realistic bits were Berlin, London, and Paris, respectively. Record International Trademark Filings in 2011. 2011 saw the highest number of international trademark applications ever filed under WIPO’s Madrid System for the International Registration of Marks (“Madrid system”) with 42,270 applications, or a 6.5 % increase compared to 2010. Applications from the member states of the European Union (EU) accounted for more than half (57.4%) of all international trademark applications, and China remained the most designated country for trademark protection. ICANN dreigt rootbeheer kwijt te raken. De Amerikaanse overheid dreigt het contract met internetrootbeheerder ICANN niet te verlengen. De lopende aanbesteding is plots ingetrokken.
