Can firms advertise using names of inactive lawyers? James Hullverson sued his family members John and Thomas Hullverson along with his former law partners Ringkamp, Becker, and Burke, and former law firm, The Hullverson Law Firm, P.C., alleging violation of the Lanham Act and the Missouri Rules of Professional Conduct. James alleged that defendants, by continuing to use John and Thomas’s names in their ads when those two are voluntarily inactive members of the Missouri bar, were falsely advertising. Google: Copyright removal requests spike to 2.5 million per week. Google announced Tuesday that the number of requests it receives each week to remove links to allegedly infringing websites in its search results has grown ten-fold over the past six months. First legal “take-down” request against a 3D file. Ulrich Schwanitz, a designer based in the Netherlands, created a file to print a 3D version of a Penrose Triangle, a graphic optical illusion. Another 3D modeller, Artur Tchoukanov, worked out how the object had been created and uploaded his file to Thingiverse. Schwanitz then issued a take-down request under the Digital Millennium Copyright Act (DCMA), claiming his intellectual property had been violated. Legal battle between Google and Belgian Publishers comes to an end. The legal battle between Google and publishers of French newspapers in Belgium has come to an end this week. The case first started in 2006, after the Belgian publishers sought a court order to prohibit the publication of their articles in Google News. The request was granted both at first instance and in the subsequent appeal. Consequently, Google seized the publication of articles from the newspapers in question. Google thereafter applied for appeal at the Belgium Supreme Court. However, now parties have managed to come to an arrangement outside of court. Both parties now agree to disagree. Op grond van voornoemde feiten en omstandigheden oordeelt de Commissie dat de bewuste publicatie geen (zuiver) redactioneel artikel is maar tevens een openbare aanprijzing inhoudt van de genoemde producten van Biohorma. Derhalve dient de uiting te worden beschouwd als reclame-uiting in de zin van artikel 1 NRC. Of al dan niet is betaald voor deze reclame doet aan het vorenstaande oordeel niet af, omdat in de definitie van reclame niet is opgenomen dat de aanprijzing tegen betaling moet zijn geschied.
