Overdracht: Complainant is holder of several trademarks for CAT, including a Benelux wordmark No. 316078 registered for, inter alia, vehicles, apparatus for locomotion by land, air or water, machines and machinery, which trademark was filed on January 30, 1973 (the “Trademark”). The registration of the Trademark predates the Domain Names’ registration by more than 30 years. (…) the Panel deems it certain that Respondent was aware of Complainant’s (well-established) Trademark when registering the Domain Names. Based on the uncontested evidence presented, the Panel finds that the Domain Name <catverhuur.nl> is being used by Respondent for commercial gain (...). This constitutes evidence of bad faith registration (…) In light of the foregoing, the Panel is of the opinion that the passive holding of the other (registered but not actively used) Domain Name <catdealer.nl> should also be considered to be in bad faith. Anti-ACTA demonstratie op de Dam. Afgelopen zaterdag zijn er in verschillende Europese steden mensen de straat op gegaan om te protesteren tegen het ACTA-verdrag, een verdrag dat onder andere piraterij en namaak moet tegengaan. Buma/Stemra probeert bestuursleden mond te snoeren. Donderdag 16 februari vergaderen de leden van Buma/Stemra over de nieuwe bestuursstructuur. Onder druk van media en politiek moet dat leiden tot een transparanter bestuur leiden. Maar artiestenbond Ntb is nog lang niet tevreden over het voorstel dat er nu ligt. Daarnaast vindt Erwin Angad-Gaur (Ntb) het kwalijk dat de stukken te laat beschikbaar gesteld zijn aan de leden. ACTA Anti-Piracy Treaty Criticized by EU Parliament President. Following the massive protests against ACTA yesterday, EU Parliament President Martin Schulz criticized the treaty on national television. “I don’t find it good in its current form,” he told ARD. Volgens de website van Perez Hilton hebben de kersverse ouders een aantal weken geleden een aanvraag ingediend bij het U.S. Patent en Handelsmerk Bureau om de naam van hun dochter te beschermen. EU Won’t Stand for Patent Abuse by Companies. The European Union has put its foot down about abuse of power in the market. EU antitrust chief Joaquin Almunia warned on Friday that he is not afraid to fine companies who breach EU rules by using their patents to squelch competition, said Reuters. Almunia made the statement during a speech in Paris as EU competition regulators investigate a legal dust up between Apple (NASDAQ:AAPL) and Samsung Electronics over intellectual property rights in 10 countries. Geluidsfragment Verhagen: ACTA, voor gewone internetgebruiker verandert er niets. Net als in veel andere steden in de wereld wordt vandaag in Rotterdam en Amsterdam geprotesteerd tegen het ACTA-verdrag. Tribler: torrentspeurder tegen internetcensuur. Mediapiraten hebben een nieuw wapen tegen auteursrechten: Tribler. Het programma kan torrents opsporen zonder tracker, en het netwerk is naar verluidt niet neer te halen. Het programma Tribler is een universiteitsproject van de Delft University of Technology. Tribler heeft geen website nodig om gebruikers op te sporen die hetzelfde torrentbestand delen. En sterker nog: het netwerk is niet plat te krijgen. “De enige manier om het neer te halen is het internet neerhalen”, zegt dr. Johan Pouwelse. Lees hier meer.
European Parliament votes on global Treaty for the Visually Impaired. Blind and dyslexic people need to read books in accessible formats such as braille, formatted audio or large print books. These are often made thanks to exceptions to national copyright laws that now work smoothly in most EU member states. Nevertheless, these books cannot legally cross borders. \An oral question in support of the European Blind Union´s petition will be debated on Wednesday, February 15th and voted upon in the plenary at noon on Thursday, February 16th.
