“This situation can and must not be changed by the ACTA agreement, which is currently under public discussion in the European Parliament and in the national parliaments of the EU Member States. As I said, I am against all attempts to block Internet websites. Even though the text of the ACTA agreement does not provide for new rules compared to today's legal situation in Europe, I understand that many people are worried about how ACTA would be implemented. I therefore welcome the intention of several members of the European Parliament to ask the European Court of Justice for a legal opinion to clarify that the ACTA agreement cannot limit freedom of expression and freedom of the Internet.” Lees hier meer.
Kamer vraagt om uitstel ACTA. Een Kamermeerderheid zal dinsdagmiddag voor een voorstel tegen het voortijdig ondertekenen van ACTA stemmen. Eerst moet aangetoond worden dat de Nederlandse grondwet niet hoeft te worden aangepast. A Dutch professor and member of a Government committee on copyright has said that it wants to relax copyright laws that stop internet users and others using protected material to make ‘creative remixes’. Bernt Hugenholtz of the Dutch state committee on copyright law said “We all love YouTube" adding "Many of the videos we find there are creative remixes of material protected under copyright. They're mostly for laughs or political commentary, or they're simply absurd. If we applied the law today strictly, we would not be allowed to do these things". Lees hier meer.

International publisher alliance shuts down piracy site. An international alliance of publishers, including Cambridge University Press, Elsevier and Pearson Education Ltd, has served successful cease-and-desist orders on a piracy operation with an estimated turnover of £7m. The two platforms, sharehoster service www.ifile.it and link library www.library.nu, had together created an "internet library" making more than 400,000 e-books available as free illegal downloads. Observatory transfer agreed by European Parliament. The European Parliament today approved the proposal to transfer the European Observatory on Counterfeiting and Piracy to OHIM and to change its name to the European Observatory on Infringements of Intellectual Property Rights. The transfer, which was voted for by a large majority of MEPs, has to be formally adopted by the Council of the European Union under the ordinary legislative procedure before being finalised. "These iconic objects are associated with the ideas of quality, comfort and luxury. And often, we see marketing agencies use them to promote computers, alcohol or even financial products. Coalitie ‘No patents on seeds’ vraagt aanpassing octrooirecht EU. De internationale coalitie ‘No patents on seeds’ heeft een open brief geschreven aan het Europees Parlement en de Europese Commissie. Daarin vraagt de organisatie om het Europese octrooirecht te herzien, en de mogelijkheid om levende organismen te patenteren uit te sluiten. “Het huidige beleid heeft immers een negatieve impact op innovatie, boeren, consumenten en biodiversiteit.” Lees hier meer.
De Consumentenbond is blij met de beslissing (ACTA in de koelkast) want de maatregelen maken mogelijk grote inbreuk op de vrijheden en privacy van consumenten. Wanneer Nederland het verdrag ondertekent kan dat ertoe leiden dat internetaanbieders worden ingezet als hulpsheriffs bij de bestrijding van downloaden. Bart Combée, directeur Consumentenbond: ‘De bewoording van het verdrag is vaag en voor velerlei uitleg vatbaar. Bovendien is het verdrag in het geheim tot stand gekomen en weigeren de deelnemende regeringen zoals Nederland om de documenten en toelichtingen uit de onderhandelingen openbaar te maken’. Handbook of quality procedures before the EPO. The "Handbook of quality procedures before the EPO" is the result of co-operation between the EPO and users, in particular the epi and BusinessEurope. The Handbook aims at providing examiners, formalities officers and applicants with a guide on preferred practices endorsed by both the EPO and user representatives. De Zurich James Joyce Foundation, die de brief ooit door een familielid van Joyce gedoneerd heeft gekregen, spreekt schande van het handelen van Ithys Press. Zij hebben naar eigen zeggen geen toestemming verleend voor de publicatie van het werk.In reactie daarop heeft Ithys Press laten weten dat de niet-gepubliceerde werken van Joyce zich sinds 1 januari 2012 in het publieke domein bevinden. TeleCuraçao krijgt uitzendrechten carnaval. De leden van de carnavalsgroepen hebben de voorkeur gegeven aan een exclusieve deal, om zo hun auteursrechten te behouden. De kans was groot dat het carnaval niet te zien was op de televisie. Zo was de eerste carnavalsoptocht, de paardenparade, niet te zien omdat er nog geen akkoord was. The "Copyright Cops" come to Britain. Visitors warned crime agency can "monitor and investigate you." The popular music blog RnBXclusive.com has been shut down by the Serious Organised Crime Agency. The site has been replaced with a warning stating that those behind the site have been arrested for fraud and that the majority of music files available via the site were "stolen" from artists. FNV-leden naar vergadering Buma/Stemra. FNV-Kiem roept leden op hun stem te laten horen bij de extra jaarvergadering van de onder vuur liggende auteursrechtenorganisatie Buma/Stemra op 16 februari. De voorstellen van het bestuur om verbeteringen door te voeren worden als onvoldoende gezien. De vakbond zal daarom samen BV Pop en artiestenbond Ntb aanvullende voorstellen indienen.
