B9 11177. Directievoorzitter Buma krijgt halve ton bonus, kosten Buma sterk omhoog. Directievoorzitter Hein van der Ree van Buma/Stemra kreeg over het jaar 2011 een salaris van 304.000 euro toegekend. Dat blijkt uit het jaarverslag, dat deze week aan de leden verstuurd is. Bovenop zijn salaris werd voor 53.000 euro aan pensioen opgebouwd en kreeg hij een bonus van 52.000 euro. Eerder was al bekend dat directeur juridische zaken Cees van Rij 700.000 euro meekreeg bij zijn vertrek, waarvan de reden nog altijd onduidelijk is. Android-rechtszaak bedreigt de softwarewereld. De rechtszaak over Java in Android bedreigt niet alleen dat mobiele platform. Als aanklager Oracle volledig wint, kan dat het einde zijn van programmeertalen en software zoals we die nu kennen. Oracle, dat Java-maker Sun heeft ingelijfd, beschuldigt Google's Android namelijk niet alleen van patentschending. De aanklager claimt ook inbreuk op auteursrechten, die volgens de softwarereus van toepassing zijn op Java-code zelf én op de api's (application program interfaces) daarvoor. Judges hate copyright trolls too. Courts are tired of copyright lawsuits choking their dockets. Consider, for example, the porno company with little to gain from the courts beyond an opportunity to personally identify downloaders--a device then used to extort settlements from them. Piratenpartij should respect the separation of powers. It is clear that the Pirate Party disagrees with the verdict handed down by the judge, which is their democratic right. But rather than supporting an appeal or seeking a change in the law, the Pirate Party decided to actively oppose the verdict and has taken steps to circumvent it. As such, their actions undermine the authority of our judiciary, and thus the foundation of our constitutional state. This is even more worrying given the fact that the Pirate Party is an official political party. A political party, even one that is not in power, should respect the separation of powers. Nokia slaat om zich heen met patentclaims. Het lijkt bijna een trend te worden: technologiebedrijven die het moeilijk hebben, proberen in elk geval nog via octrooien geld binnen te krijgen. Na Yahoo slaat nu ook Nokia wild om zich heen. Er zijn niet minder dan elf octrooizaken aangespannen tegen mobieltjesmakers HTC, RIM (BlackBerry) en Viewsonic in rechtbanken en Amerika en Duitsland. Interessante ontwikkelingen in rechtspraak over software. In twee weken tijd zijn er in drie rechtszaken interessante ontwikkelingen te melden over software en daarop verstrekte licenties. In dit blog een kort overzicht. Allereerst de uitspraak van 2 mei van het Europees Hof van Justitie in de SAS-Institute zaak. De vraag die zich in deze zaak voordeed, is of functionaliteiten en de programmeertaal van software via het auteursrecht te beschermen zijn. Het antwoord van het Europees Hof is: “nee”. Clooney en Roberts klagen mediabedrijven aan. George Clooney en Julia Roberts slepen samen twee audiovisuele bedrijven voor de rechter. De mediazaken, die onder meer filmprojectoren verkopen, hebben ongevraagd foto's van de acteurs gebruikt om producten te verkopen. Criminal Creativity: Untangling Cover Song Licensing on YouTube. There are millions of cover songs on YouTube, with around 12,000 new covers uploaded in the last 24 hours. Until recently, all but a sliver were illegal, considered infringement under current copyright law. The Pirate Bay Is Doing Well In The UK After ISP Block. We reported Monday on the UK’s absurd attempt to stop copyright infringement by blocking access to The Pirate Bay. Nobody was going to lose any sleep over the matter since tips on how to get around the blocks went up immediately after the court’s ruling. EPO and WIPO sign agreement to enhance co-operation. With the aim of further developing the international patent system to better support innovation in economies around the globe, the EPO and the World Intellectual Property Organization (WIPO) have agreed on a comprehensive three-year technical co-operation scheme. The agreement specifically aims at improving the procedural framework of the Patent Cooperation Treaty (PCT) with a view to increasing its use by patent applicants. Lees hier meer (EPO).
