B9 10724. Nederland wil snel bureau Europees patent. Nederland wil dat er snel een einde komt aan de discussie over de vestigingsplaats van het bureau voor het nieuwe patent van de Europese Unie i. Den Haag ziet het liefst nog dit eerste half jaar een besluit en gaat zich daar hard voor maken. Dat zei staatssecretaris Ben Knapen i (Europese Zaken) vrijdag in Brussel. Verder uitstel is onverantwoord, aldus de bewindsman. De Britten, Duitsers en Fransen willen het EU-patentbureau wel hebben. Ze moeten er desnoods maar om dobbelen, stelde Knapen. Lees hier meer.
EU: Nederlandse artiesten compenseren bij afschaffing kopieheffing. De Europese Commissie antwoordt op vragen van een PvdA-europarlementariër dat Nederland alleen de thuiskopieheffing mag afschaffen, zoals staatssecretaris Teeven wil, als er een garantie is dat artiesten gecompenseerd worden. Eurocommissaris van Interne Markt Michel Barnier bevestigt "dat de voorgestelde Nederlandse afschaffing van de compensatie voor het kopiëren voor privégebruik kan indruisen tegen Richtlijn 2001/29/EG als niet in een alternatief systeem wordt voorzien om te garanderen dat de rechthebbenden een billijke compensatie ontvangen." Update proposal regulation customs enforcement of IP. On December 13, 2011, the Rapporteur of the Committee on the Internal Market and Consumer Protection of the EP, Mr Jürgen Creutzmann (FDP), has published his Draft Report on the Proposal. In particular, this paper suggests that a traveller exemption clause in the Commission Proposal should be deleted. (…) Moreover, in a similar way a suggestion is made to extend the scope of the proposed Regulation to parallel imports and so-called “overruns” (goods that have been manufactured without the consent of the holder of intellectual property rights), amongst other types of infringements. (…) Both suggestions of Mr Creutzmann apparently are highly controversial. EU seeks to end long-running dispute on single patent. European Union countries are redoubling efforts to settle a dispute over the introduction of a single European patent, a move that would cut costs for inventors and industry but which, after more than three decades of debate, remains unresolved. EU leaders, including German chancellor Angela Merkel and French President Nicolas Sarkozy, meet on Monday (…) It will also offer an opportunity to end the deadlock over Europe's fragmented system of patenting, where an inventor typically now pays up to 35,000 euros ($46,000) to protect an idea, according to the European Patent Office (EPO). ACTA na dik 4 jaar behandeld door Europarlement. De omstreden antipiraterij-overeenkomst ACTA wordt sinds deze week behandeld door het Europese Parlement. Het voorstel veranderen kan niet meer, afwijzen nog wel. Naast de goedkeuring van het Europees Parlement is daar ook nog de goedkeuring van de Tweede Kamer voor nodig. Deze week behandelt de commissie Ontwikkelingssamenwerking van het Europees Parlement de overeenkomst. Die bekijkt ACTA puur vanuit het oogpunt van ontwikkelingssamenwerking en de gevolgen op dat vlak. Vervolgens formuleren zij een mening. Lees hier meer.
Commission calls on Italy to comply with EU rules on marketing authorisation of generic drugs. The European Commission has formally requested Italy to apply EU legislation concerning the marketing authorisation procedures of generic drugs. According to Directive 2001/83/EC on the Community code for medicinal products for human use, the processing of marketing authorisation procedures can be carried out without being affected by the protection of industrial and commercial property interests. On the other hand, the authorisation holder of a generic drug is not allowed to place a product on the market before the patent on the reference product has expired. Lees hier meer.
