Gerecht EU: Impulso /Impulso creador

B9 11839. Gerecht EU, 14 november 2012, zaak T-529/11, Evonik Industries teegn OHIM / Impulso Industrial Alternativo (Impulso creador).

Merkenrecht. EU-oppositieprocedure o.g.v. Spaans en Gemeenschapsbeeldmerk  ‘Impulso’ tegen de inschrijving van het woordmerk ‘Impulso creador’ (project-ontwikkeling en aanverwante diensten). Het OHIM wees de oppositie eerder (gedeeltelijk) toe en het Gerecht bevestigt die beslissing.  ‘Impulso’ is het dominerende bestanddeel en verwarringsgevaar is aannemelijk. Niet-onderbouwde stellingen doen aan dat oordeel vanzelfsprekend niet af:

39. This conclusion is not affected by the applicant’s assertion that, given the conditions under which the services covered are present in the market, the visual, phonetic and conceptual aspects of the signs at issue should not have been given the same weight (…) although it is true that one of those aspects may prevail over the others, the applicant has failed to substantiate its assertion with arguments or evidence showing how the services in question are offered or acquired. In any event, the applicant has failed to show how attaching the slightest importance to the phonetic aspect of the signs in question influenced the overall assessment of the likelihood of confusion.
