Merkenrecht. Oppositieprocedure o.g.v. Polo’s oudere Benelux beeldmerk ‘silhouet polospeler’ tegen aanvraag Gemeenschapsbeeldmerk Polo Santa Maria (kleding). Oppositie toegewezen voor kleding, afgewezen voor zwepen en zadels. Verwarringsgevaar is aannemelijk, mede omdat het silhouet van de polospeler beschikt over een ‘enhanced distinctiveness’ waar het kleding betreft.
55 (…) that the earlier mark has a distinctive character in relation to the goods in Class 25, owing to the relevant public’s familiarity with it – evidence which was not challenged by Glenton España – and, secondly, that the representation of a polo player inherently has enhanced distinctiveness in relation to the goods covered by the present action.
