Illegal content that is still too difficult to manage

B9 10652. Europese Commissie: On 11 January 2012, the European Commission adopted the Communication on e-commerce and other online services announced in the "Digital Agenda" and the "Single Market Act".

The Communication puts forward an action plan which will facilitate cross-border access to online products and content, ultimately solve the problems of payment, delivery and consumer protection and information, and assist dispute resolution and the removal of illegal content, thus helping to develop an Internet that is more secure and more respectful of fundamental rights and freedoms.  The Communication goes on to list the obstacles to the development of the Internet economy: a legal cross-border supply shortage, inadequate information and protection for consumers, inefficient deliveries and payments, , and the dangers of the spread of cybercrime.

(…) The Commission will quickly implement the European strategy for intellectual property rights, in particular by presenting a legislative initiative on private copying (2013) and a review of the Directive on copyright in the information society (2012).

(…) The mechanisms to stop abuse and illegal information must therefore be made more efficient, within a framework which guarantees legal certainty, the proportionality of the rules governing businesses and respect for fundamental rights. In the Annex, the European Commission describes in detail the differing interpretations which are at the root of the above-mentioned problems. In view of the growing volume of statutory and case-law in the Member States, it now appears necessary to set up a horizontal European framework for notice and action procedures.

In parallel to this, the Commission will revise the Directive on the enforcement of intellectual property rights in 2012 in order to combat illegal content more effectively and in a manner which upholds the internal market and fundamental rights by improving the framework for civil law proceedings. The creation of the European notice and action framework will be without prejudice to this initiative. Cooperation between stakeholders, in particular internet providers, rights-holders and payment services, in the European Union and the US, may also help to combat illegal content.
