Media Report 2017-20704, Jens van den Brink, Kennedy van der Laan: "Het bedrijf My Other Bag, Inc brengt in de VS canvas tassen op de markt waarop staat dat de eigenaar ook nog een tas heeft van merk X, meestal een luxemerk. Een van de tassen droeg de tekst: ‘MY OTHER BAG IS LOUIS VUITTON’. Louis Vuitton stapte naar de rechter om ze van de markt te krijgen. Anders dan Louis Vuitton zag de rechter de humor er wel van in. In januari 2016 wees de District Court in New York de vorderingen van Louis Vuitton af. En gaf Louis Vuitton een reprimande die de wereld overging: “In some cases, it is better to ‘accept the implied compliment in [a] parody’ and to smile or laugh than it is to sue. This … is such a case.”
Ook in hoger beroep trekt My Other Bag nu aan het langste eind. Op 22 december 2016 wees ook het US Court of Appeals, Second Circuit, de vorderingen van Louis Vuitton af: ”At the same time that they mimic LV’s designs and handbags in a way that is recognizable, they do so as a drawing on a product that is such a conscious departure from LV’s image of luxury—in combination with the slogan “My other bag”—as to convey that MOB’s tote bags are not LV handbags. The fact that the joke on LV’s luxury image is gentle, and possibly even complimentary to LV, does not preclude it from being a parody … Indeed, a parody of LV’s luxury image is the very point of MOB’s plebian product. That distinguishes this case from ones cited by LV where a trademark was used merely to “promote” or “sell” goods and services, which is impermissible.” Dus geen merkrechtinbreuk."
