New ECJ case: C-170/12 - Pinckney (Copyright). We have received notification of a new case referred to the Court of Justice for a preliminary ruling: C-170/12. The case concerns the identification of jurisdiction with regards to an alleged cross-border copyright infringement. This case and the questions referred to the court can be viewed on our website.

Anti-Patent Campaigners put their trust in François Hollande as EU Council attends to Unitary Patent Court again. The newly elected President of France, François Hollande promising "change". Will he be the first anti-patent campaigner governing an EU state? (…) In recent months the upcoming French elections brought the negotiations on the Unified Patent Court Agreement to a complete standstill, as the dynamics between the French, British and German heads of govenment and the general political climate is a crucial factor in this legislative process, especially since the only serious and realistic candidates for the attractive seat of the new UPC Central Division are Paris, London, and Munich and it is frequently announced through official channels that this question is the only remaining open issue. Huawei Files EU Antitrust Complaint Against InterDigital. Go Huawei Technologies Co., China’s largest phone-equipment maker, filed an antitrust complaint with European Union regulators that accuses InterDigital Inc. (IDCC) (IDCC) of refusing to license key wireless patents. Huawei alleges that InterDigital is abusing a dominant position for 3G technology patents agreed as industry standards and has made “unreasonable and discriminatory demands” on license fees. 8. Moderniseer het auteursrecht. Het auteursrecht is bedoeld om de productie en distributie vancultuur te bevorderen en kunstenaars te belonen. Van achterhaalde maatregelen als het downloadverbod en website -blokkades worden kunstenaars én gewone Nederlanders de dupe. Nederland moet nieuwe betaalmodellen voor films enmuziek op internet onderzoeken. Nederland moet afzien van maatregelen die internetvrijheid ondermijnen, zoals het downloadverbod, websiteblokkades, monitoring van surfgedragen afsluiting van internet.
10. Stem tegen ACTA. Het totstandkomingsproces van ACTA is zeer omstreden en het verdrag zelf is een gevaar voor een vrij en open internet. Bovendien zou dit internationale verdrag Nederland beperken in het ontwikkelen van een eigen flexibel en innovatief handhavingsbeleid voor intellectueel eigendomsrecht. Nederland moet ACTA daarom niet ratificeren en tegen nieuwe vergelijkbare verdragen stemmen. Lees hier meer (BOF).
