UPC Local Division Munich, 11 December 2023: Drie beslissingen op één dag in Huawei v Netgear

The UPC Munich Local Division issued three orders in the infringement proceedings between Huawei and Netgear on 11 December 2023. 

First, the judge-rapporteur ruled that his earlier notification that a Preliminary objection will be dealt with in the main proceedings (Rule 20(2) RoP) is not subject to review by the panel.

Second, Huawei was allowed to amend the case by including a second patent as provided for in Rule 263 of the Rules of Procedure.

Third, however, Netgear was to be heard on the question whether these (now) two patents in this case are subsequently to be heard in separate proceedings, as is possible under Rule 302 RoP.
