Beslissing Kamer van Beroep EUIPO vernietigd wegens onjuiste vaststelling van oppositiegrond

Merkenrecht. Door interveniënt is registratie van het links afgebeelde teken als Uniebeeldmerk verzocht. Tegen deze registratie is oppositie ingesteld op grond van het rechts afgebeelde teken. 

 

Het gerecht oordeelt dat zowel de Oppositie Afdeling als de Kamer van Beroep hebben miskend dat verzoekster zich in haar oppositie specifiek richtte op het ‘520’-teken van de rechts afgebeelde barcode als ‘ander in het economisch verkeer gebruikt teken van meer dan alleen plaatselijke betekenis’ in plaats van als niet-geregistreerd merk als geheel. Doordat de beroepskamer van het EUIPO de oppositiegrond onjuist heeft vastgesteld, heeft zij de voorwaarden voor een relatieve weigeringsgrond onder art. 8 lid 4 van de Verordening ook niet goed onderzocht.

 

“38. In the light of the foregoing, it is appropriate to conclude that, despite and beyond the reference, in the notice of opposition, to ‘the GS1 barcode and prefix’ and to the graphic representation of a barcode with the 13-digit sequence 5 200000 000009 underneath it, the opposition was, in actual fact, based on the trigraph ‘520’ as ‘another sign’.”

 

“45. In the light of the foregoing considerations, the Opposition Division thus erred in stating in its decision of 28 November 2014, without any reference or even any statement of reasons in respect of the sign ‘520’, that the opposition was based on the ‘[alleged non-registered trade mark cited in opposition] used in Greece’.”

 

“73. In those circumstances, it is appropriate to conclude that the contested decision is vitiated by an error in the identification of the sign cited in opposition and, consequently, by a failure to carry out a proper examination of the conditions for the application of Article 8(4) of Regulation No 207/2009.”

 

De tweede weigeringsgrond van de Kamer van Beroep hield in dat de verwijzing naar alle waren en diensten in klassen 1-45 van de Overeenkomst van Nice niet duidelijk en precies genoeg zou zijn. Het Gerecht geeft aan dat volgens Verordening 2868/95 geen indicatie is vereist van alle waren en diensten ten aanzien waarvan het in oppositie bedoelde teken is beschermd, slechts van de waren en diensten waarop de oppositie zich richt. Verzoekster heeft haar oppositie tegen de merkaanvraag op alle waren en klassen gericht omdat het ‘520-teken’ uit de barcode wordt gebruikt bij de identificatie van alle soorten waren en diensten in verschillende sectoren. Het  daarom  naar het oordeel van het Gerecht niet onlogisch dat verzoekster refereerde aan alle waren en diensten. Op grond van het bovenstaande vernietigd het Gerecht de besteden uitspraak.

 

“85. The information provided by the applicant in the application notice thus showed that the applicant intended to base its opposition to the trade mark application on ‘another sign’ used in the identification of all types of goods and services across all sectors. The identification and classification of the goods and services assumed by barcode systems, including the GS1 system, are in fact operations that may be carried out in the most diverse types of economic activities. The sign ‘520’ may thus be used in the broadest way possible as ‘another sign’.’

 

“86. Accordingly, it was not illogical, in that context and given the particular nature of the sign cited in opposition, for the applicant to refer, in the broadest way possible, to the goods and services in Classes 1 to 45, that is to say, to all goods and services.”
